Section 20 of the Landlord and Tenant Act 1985 (as amended) requires a landlord (Clarion Housing) to consult tenants and leaseholders who pay variable service charges before entering into a long-term agreement where:

• The agreement will be longer than 12 months, and
• any single tenant/leaseholder would be liable to pay more than £100 (including VAT) within a year

This notice has been sent to all residents who receive or who are liable to receive a service charge for any Waste Water Systems, Booster Pumps and Grey Water Harvesting Systems and are liable to contribute towards the servicing and upkeep of the system.

We propose to enter into a single long-term agreement for the services of a contractor to provide servicing and maintenance to Waste Water Systems, Booster Pumps and Grey Water Harvesting Systems within your region.

Long-term agreements allow us to work with contractors over a longer period of time to maximise efficiencies and achieve greater value for our customers. The length of the contracts will ensure that we are able to provide consistent delivery standards.

The contract will be for a maximum of ten years. Clarion may terminate the contract by serving the contractor a notice three months prior, such that the contract expires any time after the third contract anniversary. The contract price is fixed for the first three years, with an annual review of prices and service delivery thereafter.

If you are a tenant most costs for repairs and maintenance to your home are paid for as part of your rent and not as an additional service charge. Leaseholders and tenants will only have to pay a service charge for works carried out under the contract to their block and estate if these are rechargeable under the terms of their lease or tenancy agreement. When work becomes necessary this will be priced in line with the terms of the contract and you would be consulted on specific works exceeding £250 per property.

The contractor will provide a comprehensive Mechanical Water service and maintenance regime of Clarion stock in the North & East Regions which will be inclusive of:

• Servicing and maintenance of Waste Water Systems, Booster Pumps and Grey Water Harvesting.
• Remedial works/ reactive repairs arising from servicing inspections undertaken.
• Responsive maintenance (including out of hours)

Regular planned preventative maintenance ensures Clarion Housing Association comply in accordance with the relevant legislation and regulation with regard to water supply and waste water. Clarion Housing Association set out to ensure machinery, services and equipment are all maintained at regular intervals. Preventative maintenance ensures optimal working conditions and preserves the lifespan of the equipment.

The frequency would vary dependant on the equipment present. Typically, booster pumps used in the supply of clean water are serviced twice a year, and equipment for waste water services is serviced 4 times a year.

Clarion Housing Association robustly monitors the performance of their contractors. This is achieved by holding regular meetings to assess and monitor performance; this enables both parties to meet their obligations in order to deliver the objectives required from the contract. The Key Performance Indicators (KPI) included, form part of the contract documentation, and clearly set out our expectations. Penalties are applicable for poor performance.
